Appeal Court Suspends Judgment on Kano Emirate Crisis Pending Supreme Court Decision

In a recent development concerning the Kano Emirate leadership dispute, the Court of Appeal in Abuja has issued an order restraining the enforcement of its January 10 judgment that upheld the Kano State Government's repeal of the 2019 Emirate Council Law. This order will remain in effect pending the determination of an appeal at the Supreme Court. 

 

Previously, on January 10, the Court of Appeal had set aside a Federal High Court judgment that nullified the Kano State Government's actions under the 2024 Emirate Council Law, including the reinstatement of Sanusi Lamido Sanusi as the 16th Emir of Kano. The appellate court held that the Federal High Court lacked jurisdiction over the matter, as issues concerning traditional or chieftaincy matters fall within the jurisdiction of state high courts. 

 

Following this decision, an appeal was filed at the Supreme Court. In response, a three-member panel of justices led by Justice Okon Abang granted an injunction on Friday, restraining the enforcement of the appellate court’s January 10 judgment until the Supreme Court delivers its verdict on the matter. 

 

This injunction maintains the status quo regarding the Kano Emirate leadership until the Supreme Court provides a final resolution.
