Dr. Olufemi Olaleye, the Medical Director of the Optimal Cancer Care Foundation, has requested the Court of Appeal set aside the lower court's conviction of rape. Olaleye was found guilty of defiling his wife's 16-year-old niece and sentenced to life imprisonment.
In Nigeria News today On Wednesday, Olaleye's lawyer, Dr. Kemi Pinheiro SAN, argued that the prosecution's case was flawed due to the lack of credible independent corroborative evidence. Pinheiro also argued that the lower court erred in law by failing to invoke Section 167(d) of the Evidence Act 2011 when the prosecution failed to present the birth certificate of the alleged victim. Olaleye is seeking an order to discharge and acquit him of the offences he was convicted of in Charge No. ID/20289C/2022.
