Trump Signs Executive Order to Combat Ticket Scalping

On March 31, 2025, President Donald Trump signed an executive order aimed at combating exploitative ticket scalping practices in the live entertainment industry. The order seeks to enforce existing laws and introduce reforms to protect consumers from inflated ticket prices caused by scalpers using automated bots to purchase large quantities of tickets for resale at significant markups.

 

The executive order directs several actions:​

  • Federal Trade Commission (FTC): Collaborate with the Attorney General to ensure enforcement of competition laws within the concert and entertainment sectors. The FTC is also tasked with rigorously enforcing the Better Online Ticket Sales (BOTS) Act, promoting its enforcement by state consumer protection authorities, ensuring price transparency throughout the ticket-purchasing process, and evaluating unfair practices in the secondary ticketing market.

  • Treasury Secretary and Attorney General: Ensure that ticket scalpers comply fully with the Internal Revenue Code and other applicable laws. ​

 

Additionally, the Treasury Department, Department of Justice, and the FTC are required to deliver a report within 180 days summarizing actions taken to address unfair practices in the live concert and entertainment industry, along with recommendations for further regulations or legislation to protect consumers.

 

The signing ceremony featured musician Kid Rock, a longtime supporter of President Trump, who highlighted the detrimental impact of bots on ticket availability and pricing. He emphasized the need for fair ticket prices and suggested legislation to cap resale prices. ​

 

Major ticketing companies, including Live Nation, have expressed support for reforms addressing scalping and ensuring fair resale prices.
